Twenty states, including California, have laws governing the distribution of commercial e-mail to individuals and companies. Violations can lead to fines and even jail time. But the laws almost never are enforced. No one has been prosecuted under California's 4-year-old anti-spam law. It's the same in Delaware, which has one of the toughest laws in the country--at least on paper. Only in the state of Washington has an attorney general filed a case.
