I found out the problem (all my fault), I ran 
tune2fs -j /dev/hda5
une2fs -i 0 /dev/hda5, 

then created a new boot img file and then checked /proc/mounts
and it now reports ext3.

So I presume that is all correct not (it works, tried a few hard reboots on the test 
server).
If there is anything Ive missed,please feel free to tell me
