The proper fix would be to remove the bashism "function", and define the
function as:

start on filesystem
stop on runlevel S
At shutdown or reboot, therefore, sshd is not stopped.

A more useful branch to start from might be

Oops, I also meant to ask you to cat the /var/run/sshd.pid to make sure
it is in fact the same as the one in status.
My suspicion is/was that the upstart managed sshd is conflicting with a
/etc/init.d/ssh managed sshd. On second thought I'm not so sure.
Can you try running an sshd in debug mode o
+1 on Maverick after installing upstart 0.6.6-4 on 2011-02-11.

Now, it shouldn't have changed to a file - it's possible you hit bug 387189

with debugging. :-( So when the problem reoccurred, I didn't get the
debug output.
But I ran strace of the apcsmart process, you might be able to
use that instead.
