Indeed it appears the patch needed to fix this bug was included in the
latest 2.6.35-rc5 mainline kernel:
linux-2.6$ git describe --contains d1e89f37de2845db364ef6d67586cd882f86b557
v2.6.35-rc5~14^2~24^2~1
We recently rebased the Maverick tree to 2.6.34-rc5. Thus the Maverick
kernel now
appears to be fixed for me with latest kernel.

Indeed it looks like the fix is in the iwlwifi-2.6.git tree. The patch
however has not yet been applied to the upstream mainline tree, ie

was fixed. However, in both Maverick kernel versions of today I still
