It may have been fixed in hardy but it is doing it in Jaunty (I have all the
latest updates as of today)
going into the systems setting, file associations it is possible to edit the
entries for kate from kate %U to kate -u %U. This is rather time consuming and

The requested behaviour is not KDE standard behaviour. However, it can
be achieved by making the command for kate 'kate --use', which will
cause kate to open new files in the first existing instance.
