I have that problem too. I was on Lucid and went on Maverick. I had the problem on both. I tried lots of things and lots of patches i found on the internet and here. Nothing worked. The only time I managed to install FGLRX was by downloading the 10.9 version on amd's website and changing kcl_ioctl.
