I was missing a path to scan:
OnAccessIncludePath /home/user
With that and clamonacc running I get on access scans.
Which means that clamonacc should have it's own service file.
Though I think I'm about to give up on it, as after that I receive
warnings about:
^lstat() failed on: /home/use

works with a manual scan.
I am able to run clamonacc by appending to /etc/clamav/clamd.conf
OnAccessExcludeUname clamav
Even this shows no sign of actually doing on access checks.

I discovered the problem was a packaging problem with the nvidia
experimental packages, they apparently didn't include the dependencies
required to actually compile the module so the compilation was failing
without warning resulting in broken drivers.

Seems to me to be a Xine / Gstreamer / NVidia problem. I was happily
using Ubuntu 8.10 with my NVidia 8600GTS running the restricted drivers
using mplayer, vlc and totem-gstreamer and I tried installing totem-xine
