oh my can we mark this as solved it's not a bug actually the spdif was
turned off by default during the startup in ubuntu 12.10 i solved it by
opening the alsamixer on the terminal and pressing M did turned on the
spdif.

result. already tested on windows 7 and ubuntu 12.04 red light is
