If the way systemd detects WSL supported versioning that would be an
easy task. As that's not the case, to implement your suggestion we'd
need to ship a systemd generator that would subprocess `wsl.exe
--version`, parse the outputs and decide whether to block or not
systemd-binfmt.service. It sound

Attached is the debdiff proposed for wsl-setup on 22.04 to make it
possible to build images of that LTS in the new WSL tar-only image
format.
