Ive solved my problem
I had the wrong enet card specified in atalkd.conf
yes there was a big Dohhh!! and a loud crashing sound
of my head hitting my desk

i'd say that if you run atalk and it doesnt give you any crap on the server
side you've got a 50/50 chance

make sure /etc/atalk/config has this line ATALK_NAME=yer
servers name
don't forget to specify yer network interface in /etc/atalk/atalkd.conf
you could put a - in /etc/atalk/afpd.conf
i ended up having to comment out the part of
/etc/rc.d/init.d/atalkthat te

Yes it is indeed. I believe that Apple will be slowly phasing out AFP
support in favor of NFS. AFP support will only be there initially for
backwards compatibility.
