Joe, to add a little you are only required to have a transponder above 10K.
As Randy stated, YES you can fly above Class B with a transponder or radio
communication as long as it is below the 10K altitude (that would be a
really tall Class B). I would encourage you to look at the upside down

What happened to raise the question was on the way to Va. the
other day the controller had given me the permission and transponder
code, as soon as I started to enter the code I lost transponder
communication - contacted the controller and he reported no return and
stay clear of class
