Afraid I can't think of any documentation for such a hypothetical case.
Did something specific happen with a project that somehow misused data?
Are you perhaps confusing the foundation who develops the software with
perhaps another entity that has used the software?

Is there a way I can get some documentation from your Apache group showing how
the right and privacy of individuals who are not in Development or did not
volunteer to be used along with testing but later found out they were.
