I think you are describing one of the differences between the Gnome
window manager and the Unity 2D desktop. There is an option to login
using the old Gnome desktop, but it is unlikely you used it -- you would
have noticed bugs far more bothersome than menu bar behavior.

My apologies. My comment was incorrect. I cannot replicate your bug
with a terminal running in with the default Unity 2D window manager.
