the dialog used to have one, anyway upstream has no interest to make
epiphany-browser works correctly when using xulrunner and is switching
to webkit and ubuntu doesn't use epiphany-browser as its default browser
so I doubt many work will be done on the current version either upstream
or ubuntu

It's not possible to change layout.spellcheckDefault value in about:config
page. Every time I've tried to change it the value go back to en-US.
I've tried many different value (fr,fr_FR, fr-FR,fr_FR.UTF-8 and others) but
each time new value is not saved.
But I don't know if this problem happens
and just to make life hard Bug #201396 means that you can't change the
value of layout.spellcheckDefault in about:config

check option in the epiphany preferences. why is the spell checker not
on by default?

You can change layout.spellcheckDefault in about:config to activate the
spell checking, the code should change this option when the spell
checker option is activated though, that's an upstream request
