Vzhledem k tomu, že zasílání informací elektronickými prostředky je upraveno
zákonem č. 480/2004 Sb., který nabyl účinnosti dne 7. září 2004, a dle § 7
tohoto
zákona je šíření obchodních sdělení elektronickými prostředky umožněno pouze za
předpokladu, že adresát dal předem prokazatel
