I ran into this problem as well turns out I created the problem as
xenman had worked previously. I had subsequently installed
xen-ioemu-3.0-unstable
xen-utils-3.0-unstable-1
uninstalling these (not needed really, since I had xen-3.1 installed)
resolved the issue.

The attached patch extracted from upstream CVS adds compatibility with
kernel 2.6.23 to lirc 0.8.0/ 0.8.1/ 0.8.2. Given that kernel 2.6.23 isn't
even in NEW yet, I wouldn't call this issue grave, but rather minor at best.
