Hi,
I just tried what Markus Steinborn tried and it seems to work for me (i.e.
the setuid bit isn't lost):
# ls -l passwd
-rwsr-xr-x 1 root root 43280 Sep 26 15:59 passwd*
# cat passwd.acl
# file: passwd
# owner: root
# group: root
# flags: s--
user::rwx
group::r-x
other::r-x
# setfacl --rest

I've informed upstream, will wait to get their thoughts.
The developers are English speaking though, so I guess they
will only have the patch mail to work from (and not the
discussion link you kindly fwd
package: acl
tags: 270099 + patch
severity: important

An additional remark: Please note that the patch for version 2.2.39
works with 2.2.23.
