I took a look at the bug database and there are indeed
some reports of bug like this one. The problem is that
they do not seem to get fixed. We need to solve this
problem on a rather short term, does anyone know a

Ah ... I see the problem.
You are correct. Axis should be generating a message with an empty
body, but instead it is adding the element. I seem to
recall that this issue was raised last summer, so I suggest you search
Jira for a resolution. Otherwise, please file a bug report.
