Yes, having 40 slots will require you to purchase the TSM EE license.
Wether or not you use the slots is irrelevant. You are charged for the
size of the library, not the amount of slots you're

IBM only charges you for what you tell them you are licensing. But if
you cheat, that raises the cost to the rest of us.

Payment is for the LTO library not for the TSM License though.

into the ever popular 'enterprise' 40 slot dilemma.
We currently have a IBM 3583 library with 2 lto1 drives and 2 columns
installed (36 slots) Running TSM 5.1.92.
