While the NEC does give the AHJ broad powers, most states (or counties or cities) limit that authority in some manner such as requiring 3rd party evaluation (listing) of equipment.  That's why UL listing is so vital to the manufacturers.  Most states also have a list of exceptions to the NEC that installers also need to know.  There's more than one book that the AHJ can use as a basis to deny approval.

Basically I call these 2 sections of the code read together as the 'AHJ = The Man' ruling.
I guess there was some politics involved in NOT putting that together for all to see?

The NEC doesn't require UL listing.  The most appropriate section of the code about this is Article 110, Requirements for Electrical Installations, it requires equipment to be approved.
