iPeng enforces bitrate limiting to 128kbps over 3G networks now. This is an Apple requirement.
This is probably why your 128kbps mp3s are not affected, they are already available at 128kbps. Not that the server re-encodes your 96kbps files.... I believe that's a bug, after all the setting is called "bitrate limiting".
