Because W3C says so. The closest thing I found to an answer is http://www.w3.org/TR/xhtml1/#h-4.4 although I really didn't dig deeply. validator.w3.org doesn't like it, tidy doesn't like it. Opera doesn't like it. I don't have IE, and am too lazy to boot up a gecko-powered browser. Even if it _is_ valid (which I really don't think is the case), it's not usable.
