In the alternative, and without prejudice to the foregoing, if it is found by a properly constituted and statutorily empowered finder of fact that the quotes are accurate, and that they are either not taken out of context or that the lack of context does not affect the contents thereof, then frank states, and the fact is that the said utterances are copywrited intellectual property, and therefore subject to royalty fees, and that the unauthorized use thereof gives rise to punitive as well as other compensatory damages, including but not limited to pecuniary and non-pecuniary losses caused by such unauthorized usage.
