Sure is. 1. open source is by definition not ripped off. 2. if you bought the rights to it it is not ripped off. 3. If you cloned (reverse engineered) it with a different look and feel it is not ripped off. However, most of the heroes of the early personal computer era were avowed hackers in the original sense of the term, not the 2 current usages, and they think everybody is doing the same thing with their stuff. I noticed a long time ago that what someone accuses others of is what you can expect them to do if they get the chance.
