I'm not an openssl expert, but as far as I remember I have Apache 1.3.9 with mod-ssl patch 1.3.7 using openssl 0.9.4 running using a Thawte certificate under Redhat Linux 6.0 with no problems. I'm sure there are people that can help you if you provide more information on your configuration.
