Actually, I think that the answers to your questions are clear from 
the published material, Lance, but here...

No.  (no change from the current restrictions - the ToS does not allow 
the use of copyrighted or trademarked names anywhere, but any 
enforcement of that is outside the software).

Matters of civil law are outside the scope of this list, and I don't 
believe the question is really answerable in any context.

There are very good mechanisms in the new name system to make avatar 
identities (not the RL identities behind them) unambiguous.   If you are 
engaging in any exchange with someone for which identity is important, 
you should learn how to use them.

This list is really not the place for this discussion - the Display 
Names blog comment area is much better.
