Interesting that you should bring up eCos.

Look at what happened there. *LOTS* of closed source
packages to eCos exists....

I'd hate to have closed source targets + interface drivers
in OpenOCD and if you use the eCos license you'll get that
for sure. I know there are hardware vendors who's aching for it.
Look at the www.vinchip.com guys. Where is the OpenOCD source
code that they wrote?

You'd have to be careful as the devil to make a license
allow FTDI non-GPL compliant code for the purposes of USB
while not mentioning FTDI specifially and avoiding targets
+ interface closed source.

Another stated policy of OpenOCD is that all hardware vendors are
equal. So neither FTDI, nor USB could be mentioned in such
an exception.

It's a million times easier to just fix this technically than to try
to solve this with licensing.
