Assuming your document follows (or can be made to follow) the "macro divisions 
of a document" structure* then the normal way would be to disable the footer in 
the frontmatter division and only enable it in the bodymatter division which is 
where your chapters would be placed.

To move the footer down the page a little you can reduce the sizes of 
bottomspace, footer and footerdistance in the \setuplayout command.
