FWIW, the parts of the IXP400 Access Library relevant to ethernet (except the microcode which could be made into a binary blob for loading by the firmware loader) are available (from Intel) under the eCos variant of the GPL. The IXP400 Access Library is a complete horror. It'll need completely rewriting to even have a chance at getting into the kernel.
