The difference between those two locations is that the one in /usr is system wide (and thus not writable by the user), and the one in ~/ is only for that user (and obviously writable by that user). When you use the theme downloader in mythtv, it downloads to ~/
I'll go ahead and commit the zoneminder fix to the github repo. It looks like it might* have been configurable in v27 of the theme.
