On a CD, I could see this as a possible problem as the thin layer that
actually holds the data is right on top of the CD.  They got a little
smarter for DVDs, and sandwiched the fragile data layer between two
layers of plastic.  I doubt a marker will eat through that.

The problem I had with labels on DVDs, even using a doodad to properly
center them, was lots of standalone DVD player video glitches and
lockups.  Cured every time by reburning sans label.
