I'll answer my own question. It seems it's not a problem of the kernel and userland being out of sync, but rather /sbin/sysctl was hosed too. rebuilt and problem disappeared. I'm guessing that either I had some junk in /usr/obj/sbin or the patch instructions for libssl need to mention doing a "make clean" after "cd ../../sbin".
