What would be considered upstream for mkhybrid? mkisofs (which mkhybrid seems to be based on) is now part of the cdrtools package (http://cdrecord.berlios.de/private/cdrecord.html). And as announced[1] while mkisofs is still GPL, it seems to depend on libscg which is licensed under Sun's CDDL. [1] ftp://ftp.berlios.de/pub/cdrecord/alpha/AN-2.01.01a09
