As far as I know, if you leave it open you're not liable because you cannot prove who would have strolled by. If you put any sort of security at all to prevent outsiders it can be reasonably assumed that you were the person who did whatever you did... Now, I am not a lawyer but I have had interesting discussions with legal types about it. There is mixed views and there was no precedent last we discussed it. A
