The patents are ok if you accept CDDL, which OpenBSD doesn't. Illumos is mostly under CDDL anyway. AFAIK FreeBSD and NetBSD accept CDDL for this. I don't think "no one in the Linux .. worlds is terrified of the ZFS patents" is correct. The situation there is complicated. It's distributed as a kernel module or FUSE package, not as part of the Linux kernel, and people using it need to accept CDDL.
