yes! that is what often  happens to me. What   I usually do is to command tab 
out of mail or wherever I am trying to use the spell check and command tab back 
that usually solves the issue.
Of course the best is to go to window chooser and close the alert  , but I just 
command tab quick and that gets the focus of the alert out of the screen I am 
working in.
