I don't see this. Could you attach a small example LyX-file?
A example, with my ERT inserted, or with the (wrong) placed lyx-reference? Maybe it only occours if you us it like me: Create an equation, and set a mark.Now create another equation an try to insert the reference ABOVE the "=" sign.
