It has to be applied before it can be marked as fixed.

These look the same to me ;)
The process is :
o make a patch
o get it reviewed and applied
o close the bug as RESOLVED FIXED (unless it still needs
applying in 1.3cvs, and the patch is going to be backported)
It doesn't matter much if you don't follow things to the letter. Nobody
cares - we don't really have enough developers for process to matter.
