Oracle has not chosen to persue any action against Canonical.  I presume that 
a Canonical lawyer would have sent a letter to Oracle saying "we believe this 
to be legitimate, if you believe otherwise please contact us before we 
release" which would limit Oracle's ability to sue them.

In any case it's not a problem for people who use Ubuntu.
