Well, Oron, let's not get all carried away. You seem to be focused on crapware that does not even compile and cannot be maintained, and in those cases you are completely right. However, escrow plans exist to make sure the SW is actually maintainable by the user or by third parties in case the vendor cannot provide support for one reason or another, and such maintainability is verified before any contract is signed (unless the cusomer is a complete muppet).
