I beg to differ, but according to the open-source definition, a software
needs more than that to be called open source:

http://www.opensource.org/docs/definition_plain.html

It needs to be freely distributable, freely modifiable, etc. Now, the FSF
does not make claim to software that is internally used, or was modified
for internal use.
