The problem seems to be that the cpu will not run in a higher power
limit for any length of time

  The latest thermald version, 2.4.8, does not have this issue.  Thermald 
versions prior to 2.4.8 do have this issue.  See:

  The version of thermald should be updated to 2.4.8, or the code that
