Dared to test 3.10.2 from ppa mainline. This works without any of the issues of 3.9.8 from the ppa mainline on raring. So the issue with 3.9.8 seems specific to this kernel. Now I wonder if the issue is specific to 3.9.8 mainline itself or to the ubuntu ppa build of 3.9.8 mainline. Finding out would be interesting.

From 3.9.8 this is not anymore the case. 3.9.8 boots, but causes all process to report 200% cpu usage on a dual core system and the fan to run max speed all the time. This on a DELL E6500 with intel core 2 cpu and the 64 bit kernel. This is strange, since 3.9.8 should only include minor and safe changes agains 3.9.7. Unfortunately, this has the negative effect that people who have open bugs against the kernel cannot anymore test and report if the bug is fixed on newer kernels.
