How to reproduce
After some attempts of
1. clicking "Smart Patch tool"
2. Change brush with popUpPalette
3. use patch tool.
The assert is triggered. this provoques the tool to be in the active mode, so
even if its selected the tool will appear to be broken.
I could only trigger the assert with the "Smart Patch tool"
