Currently, we create all stacks passing the CAPABILITY_IAM value for capabilities to the stack creation API request. Sometimes when the first creation of a stach fails, the stack is rolled_back but not deleted. If this is the case then next request toc reate the stack will fail because of a name collision. Could this be what you are experiencing?
