First, the instances themselves are counted (once the appropriate tag has been migrated from the spot request) and then the spot instance request itself is counted. If the plugin is responding to sudden demand, the cap seems to work fine since the SIRs are created before the tags make it to any instances. But, if you're at a steady state with the max number of SIRs, then terminating one of the requests will still leave you over the cap.
