Is there an chance that you could put BSD realpath source and compile it in PHP. This should solve the fopen and safe_mode bug on some systems (unixware, TRU64UNIXX) whe realpath doesn'tt behave the way PHP expects.
If you decide to make a patch for this, then make sure you take the FreeBSD 4.8-STABLE branch. The re-entrant version of BSD realpath has had a bug for some time and this is only fixed in 4.8-STABLE and 5.x with __FreeBSD_version 500110.
