It won't let you do that if it is your preferred publisher. Is

Found a workaround
Do this first
# pkg set-publisher --no-refresh -P -O http://pkg.opensolaris.org/dev
opensolaris.org
then you can unset-publisher of any other publishers pointing to opensolaris.org
Hope this helps anyone else running into this problem...
