I had this problem when I ran out of ZFS partition space, so it wasn't able to copy the data in the promotion. This was on a multi-boot laptop with only 10GB set aside for OpenSolaris. After a few updates, it used up nearly all the disk and I'm now stuck booting to the BE before the update, unable to activate and clean up the latest one.
I'm waiting for the next CD image, and will then repartition and reinstall from scratch, I think. But check how much space you have left, and whether there's any snapshots you can clear out to make room? I'd be surprised if you went straight from install to update, though.
