A VERY apt analogy, I must say, and perfectly valid reasoning against "spam-cops". Before testing or even providing tools for testing of spam relays to others there should be a copy of a mail sent to the about-to-be tested server-administrator informing him of the intended test. By all means, this would subject to litigations of "tresspassing", but even made from a reliable authority, it would force people to be alert to such vulnerabilities. Unless the person responsible for the domain is unresponsive to mails, punishing people without notice is equivalent to "punishing for not being smart". There would be admins who don't reply to such mails, and later complain that there had been illegal use of their resources. The copy would have to be somewhat serving as a proof-a very sketchy one nevertheless, as there would not be a confirmation of receipt. Personally, when I have am one of the "suits", and am running a mail server, I would definitely find it tantamount to tresspassing, if someone without an intent of sending a mail to my domain to one of my users, uses my resources. These people had every right to file such a suit. However, the problem was that a well-meaning guy had used their resources, but had no "official" authority to do so.
